2. 배경

미얀마는 버마라고도 불리며, 1948년 1월 영국으로부터 독립한 이후 정치적 불안에 시달려 왔다. 1958년부터 1960년 사이에는 군부가 민주적으로 선출된 우 누 총리의 요청으로 정치적 내분을 해결하기 위해 임시 과도 정부를 구성하기도 했다.[36] 군부는 1960년 버마 총선을 치른 후 자발적으로 민간 정부를 복원했다.[37] 그러나 2년도 채 지나지 않아 1962년 쿠데타를 일으켜 권력을 장악했고, 네 윈 장군의 지도 아래 26년간 군사 통치가 이어졌다.[38]

1988년에는 전국적인 시위(8888 항쟁)가 발생하여 네 윈이 퇴진했다.[39] 같은 해 9월, 군부 최고 지도자들은 국가 평화 개발 위원회(SLORC)를 결성하여 권력을 장악했다.[39] 이 시기에 아웅 산 장군의 딸 아웅산수찌가 민주화 운동가로 떠올랐다. 1990년 군부는 자유 선거를 허용했고, 민주주의 민족 동맹(NLD)이 압승을 거두었지만, 군부는 권력 이양을 거부하고 아웅산수찌를 가택 연금했다.[40][41][42]

4. 쿠데타의 원인 및 목적

2020년 미얀마 총선에서 민족민주연맹(NLD)이 압승을 거두자, 미얀마군은 선거 결과를 부정하며 쿠데타를 일으켰다.[340] 표면적으로는 선거 부정을 명분으로 내세웠지만, 실제로는 미얀마 정치에서 군부의 영향력을 유지하려는 목적이 컸다.[92][93]

미얀마군은 1962년 쿠데타 이후 오랫동안 미얀마 정치를 지배해왔으며, 2011년 민주화 이후에도 의회 의석의 25%를 차지하는 등 상당한 권력을 유지했다.[340] 2020년 총선에서 NLD가 압승하면서 군부의 입지가 약화될 위기에 처하자, 쿠데타를 통해 권력을 장악한 것이다.

2021년 10월 18일, 민 아웅 흘라잉은 쿠데타 반대 시위로 수감된 5,636명의 수감자를 석방한다고 발표했으나, 정치범 지원 협회에 따르면 그 후에도 전국적으로 7,300명 이상의 시위자가 여전히 수감되어 있었다.[87] 2022년 1월 10일, 아웅 산 수 치는 무전기 소지 및 코로나19 방역 수칙 위반 혐의로 4년 징역형을 선고받았다.[88]

2022년 8월 1일, 미얀마 군부는 민 아웅 흘라잉의 요청에 따라 비상사태를 6개월 더 연장했으며, 이는 군부의 국가 국방 및 안보 위원회에서 만장일치로 채택되었다.[89] 한편, 미얀마 전역에서는 국민통합정부의 국민방위군에 의한 무장 반란이 발생했다.[24]

2021년 2월 2일, 미얀마 전역의 공무원들과 의료계 종사자들은 쿠데타에 반대하며 전국적인 시민 불복종 운동을 시작했다.[353] 양곤 주민들은 군사 쿠데타에 반대하는 의미로 자동차 경적을 울리고 솥을 두드리며 "악은 물렀거라!"라고 외치는 '카세롤라소' 시위를 벌였다.[354] 일부 양곤 주민들은 오후 8시에 군사독재 정권 타도와 아웅 산 수 치 국가고문 겸 국민민주연맹 총재의 석방을 요구하는 15분간의 시위를 벌이기도 했다.[355]

쿠데타에 반대하는 시민 저항 운동은 시민 불복종, 노동 파업, 군부 보이콧 캠페인, 냄비 두드리기 운동, 빨간 리본 캠페인, 공개 시위 등 다양한 형태로 나타났다. 세 손가락 경례는 시위의 상징으로 널리 채택되었고,[126] 네티즌들은 아시아의 온라인 민주주의 연대 운동인 밀크티 동맹에 참여했다.[127] 8888 항쟁의 찬송가였던 "Kabar Ma Kyay Bu"(ကမ္ဘာမကျေဘူး)는 시민 불복종 운동의 시위 노래로 다시 불려졌다.[128]

2월 3일에는 미얀마 국군과 연계된 상품 및 서비스에 반대하는 '미얀마 국군 산업 불매' 운동이 시작되었다.[356] 불매 운동 대상에는 국군의 주요 사업체이자 통신사업자인 Mytel, 미얀마 최대 맥주 업체인 미얀마 맥주, 국군 최고사령관 민 아웅 흘라잉의 딸이 세운 영화 제작사 세븐스센스 등이 포함되었다.[356] 사가잉 관구의 Mytel 기술자 71명은 군사 쿠데타에 반대하여 사직하기도 했다.[357]

2월 1일에 타이 왕국 방콕의 미얀마 연방공화국 대사관 앞에서 200여 명의 미얀마인과 일부 태국 민주주의 진영 운동가들이 군사 쿠데타에 반대하는 시위를 펼쳤다. 시위대 가운데 일부는 2020년 태국 시위에서 상징으로 쓰인 세 손가락 경례를 했다.[358] 경찰이 시위를 단속하는 과정에서 시위대 가운데 두 명이 다쳐 병원으로 옮겨졌고 두 명이 체포됐다.[359] 일본국 도쿄도의 유엔 대학교 앞에서도 쿠데타에 반대하는 미얀마인들의 시위가 있었다.[360] 2월 3일에는 150명 이상의 미얀마계 미국인들이 워싱턴 D.C. 주재 미얀마 대사관 앞에서 시위를 벌였다.[271]

뉴질랜드,[361] 독일,[362] 미국,[363] 스웨덴,[364] 스페인,[365] 영국,[366] 오스트레일리아,[367] 일본,[368] 캐나다,[369] 튀르키예,[370] 프랑스[371] 등은 쿠데타를 규탄했으며, 백악관에서는 군사쿠데타 세력에게 경제 제재를 경고했다.[372] 대한민국,[373] 말레이시아,[374] 방글라데시,[375] 싱가포르,[376] 인도,[377] 인도네시아,[378] 중화인민공화국,[379] 파키스탄,[380] 필리핀[381] 등은 우려를 표명했다. 캄보디아과 태국 등은 국내 문제라며 언급을 자제했다.[382]

캄보디아, 태국, 그리고 베트남은 쿠데타를 내부 문제로 특징지으며 어느 쪽도 명시적으로 지지하지 않았다.[235][236][237]

2021년 2월 26일, 대한민국 국회는 쿠데타를 규탄하는 결의안을 통과시켰다.[243] 2021년 3월 5일, 일본 내각관방장관 가토 가쓰노부는 국가행정위원회(SAC)가 주도하는 정부에 시위 진압에 치명적인 무력 사용을 중단할 것을 촉구했다.[244]

대한민국 외교부는 2021년 3월 12일, 대한민국이 미얀마와의 국방 교류를 중단하고 무기 수출을 금지하며, 다른 전략 물품의 수출을 제한하고, 개발 원조를 재검토하고, 미얀마 국민이 상황이 개선될 때까지 대한민국에 머물 수 있도록 인도적 예외를 허용할 것이라고 발표했다.[246]

2021년 3월 27일, 8개국이 미얀마 군대의 날 열병식에 대표단을 파견했다.[247]

5. 3. 2. 국제기구 차원의 반응

국제연합(UN)[383]과 동남아시아 국가 연합(ASEAN)[384], 유럽 연합(EU)[385] 등 국제기구는 우려를 표명하고 양측의 대화를 촉구했으며, 유럽 연합은 쿠데타를 규탄하고 억류된 사람들의 석방을 요구했다.[385]

쿠데타 이후 유엔 안전 보장 이사회(안보리)가 긴급 소집되어 미얀마 군부의 행동을 규탄하고 억류된 사람들을 석방하며 민주주의 복구를 촉구하는 성명 초안이 제출되었다. 그러나 중화인민공화국과 러시아 대표가 본국 검토를 이유로 반대하여 15개 회원국 만장일치 지지를 얻지 못했다.[386] 중화인민공화국과 러시아는 안보리 상임이사국으로 거부권을 보유하고 있다.[256] 비상임 이사국인 인도와 베트남도 결의안에 대해 유보적인 입장을 표명했다.[257]

이후 협상을 통해 2021년 3월 10일, 미얀마 군과 쿠데타에 대한 명시적 규탄, 유엔 제재 위협을 삭제한 후 15개 안보리 이사국 간 합의가 이루어져 "의장 성명"(결의안보다 한 단계 아래)이 발표되었다. 성명은 폭력 규탄, 폭력 중단 및 군부 자제, 구금된 민간 정부 관계자(아웅 산 수 치 국무 자문, 윈 민 대통령) 즉각 석방, 미얀마 헌법 틀 내 당사자 간 협상을 통한 해결을 촉구했다.[258][259][260][261]

UNSC 의장 성명은 또한 모든 당사자에게 아세안의 중재 노력 및 미얀마 주재 UN 특사와의 협력, 미얀마 내 모든 사람에 대한 인도적 지원 보장을 촉구했다. 또한 2017년 미얀마 라카인 주 군사 탄압을 언급하며, 이는 로힝야족 무슬림 소수 민족을 대상으로 한 것으로, 대부분 국외로 추방되었으며 현재 상황이 로힝야족의 "자발적이고 안전하며 존엄하고 지속 가능한 귀환"을 막고 있다고 지적했다.[258][259][260][261]

훈 센과 조코 위도도 (캄보디아와 인도네시아 지도자)가 2021년 4월 쿠데타 관련 특별 아세안 정상회의에 참석했다.


동남아시아 국가 연합(아세안)은 2021년 4월 24일 자카르타에서 특별 정상회의를 소집, 민 아웅 흘라잉을 비롯한 회원국 정부 수반 및 외무장관이 참석했다. 쿠데타 대응으로 형성된 미얀마 국민통합정부는 아세안 지도자들과 접촉했으나 공식 초청받지 못했다.[262][263] 회의에서 민 아웅 흘라잉은 국가 원수로 언급되지 않았다.[264] 아세안은 미얀마 폭력 중단, 관련 당사자 간 건설적 대화, 대화 촉진을 위한 아세안 특별 특사 임명 등 민 아웅 흘라잉과 "5개 합의"에 동의했다고 발표했다.[265]

2021년 5월 28일, 브루나이, 캄보디아, 인도네시아, 라오스, 말레이시아, 필리핀, 싱가포르, 태국, 베트남 정부는 미얀마 관련 UN 결의안 초안 완화를 제안하며 무기 금수 조치 요구 삭제를 포함시켰다.[266]

2021년 7월 27일, UN 특별 보고관 톰 앤드루스는 UN 안보리와 회원국에 미얀마 "코로나19 휴전" 진전을 촉구했다. 당시 600명 이상 의료 전문가가 체포 영장을 피해 도피 중이었고, 67명은 미얀마 전역 코로나19 감염 및 사망 급증 속에서 구금되었다.[267]

2021년 7월 27일, 뉴욕 유엔 앞에서 미얀마 "코로나19 휴전" 지지 시위가 있었다.

5. 4. 시민 단체

쿠데타에 반대하는 시민 저항 운동은 시민 불복종, 노동 파업, 군 보이콧 캠페인, 냄비 두드리기 운동, 빨간 리본 캠페인, 공개 시위, 선출된 대표자들의 선거 결과 공식 인정 등 다양한 형태로 나타났다. 세 손가락 경례가 시위의 상징으로 널리 채택되었고,[126] 네티즌들은 아시아의 온라인 민주주의 연대 운동인 밀크티 동맹에 참여했다.[127] 8888 항쟁의 찬송가로 처음 대중화된 "Kabar Ma Kyay Bu" (ကမ္ဘာမကျေဘူး|까바 마 째 부my)는 시민 불복종 운동에 의해 시위 노래로 부활했다.[128]

쿠데타 이후 양곤 등 도시 중심부 주민들은 매일 저녁 냄비와 프라이팬을 두드리는 카세롤라소를 벌여 악을 몰아내는 상징적인 행위로 쿠데타에 반대하는 뜻을 표명했다.[129][130][131]

2월 2일, 전국의 의료 종사자와 공무원들은 쿠데타에 반대하는 국가적인 시민 불복종 운동을 시작했으며, 수십 개의 국립 병원과 기관의 노동자들이 노동 파업을 시작했다.[118][132][133][134] "시민 불복종 운동"이라는 페이스북 캠페인 그룹은 2월 2일 시작 24시간 만에 15만 명의 팔로워를 확보했다.[135][136] 3월 3일 현재, 110개 이상의 정부 병원 및 의료 기관의 의료 종사자들이[137] 운동에 참여했다.[135] 노동 파업은 노조, 부처, 대학교, 공장, 구리 광산, 학생 및 청년 단체로 확산되었다.[138]

3월 3일, 의료 종사자들은 NLD와 관련된 빨간색을 사용한 빨간 리본 캠페인(ဖဲကြိုးနီလှုပ်ရှားမှု)을 시작했다.[139][140] 빨간 리본은 미얀마 전역의 공무원과 노동자들이 군사 정권에 반대하는 상징으로 채택했다.[141]

3월 3일, "군부 기업 구매 중단" 캠페인이 시작되어 미얀마 군과 관련된 제품 및 서비스에 대한 보이콧을 요구했다.[142] 미얀마 군의 사업 포트폴리오에서 표적이 된 상품과 서비스에는 국영 통신 사업자인 Mytel, 미얀마, 만달레이, 다곤 맥주, 여러 커피 및 차 브랜드, 민 아웅 흘라잉의 딸이 공동 설립한

쿠데타 이후 공개 시위도 나타났다. 2월 2일, 일부 양곤 시민들은 오후 8시에 15분 동안 짧은 시위 집회를 열어 독재 타도와 아웅 산 수 치의 석방을 요구했다.[144] 2월 4일, Tayzar San이 이끄는 30명이 만달레이 의과대학 앞에서 시위를 벌여 4명이 체포되었다.[145][146]

5. 5. 기업

태국 최대 산업 단지 개발업체인 아마타는 2020년 12월에 건설을 시작한 후 쿠데타에 대응하여 양곤의 10억달러 규모의 산업 단지 개발 프로젝트를 중단했다.[171][172] 스즈키 자동차 등 여러 제조업체들이 쿠데타 이후 미얀마 내 운영을 중단했다.[171] 양곤 증권 거래소 또한 2월 1일부터 거래를 중단했다.[171] 미얀마의 부동산 시장은 쿠데타로 인해 붕괴되었고, 매매 거래가 거의 100% 감소했다.[173]

2월 4일, 프랑스 석유 다국적 기업인 토탈 SE는 쿠데타가 국내 운영 및 프로젝트에 미치는 영향을 검토하고 있다고 발표했다.[174] 4월 4일, 군사 정권에 대한 지급을 중단하지 않고, 공공 사용을 위해 전기를 생산하는 야다나 해상 가스전에서의 운영을 중단하지 않겠다고 밝혔다.[175]

2월 5일, 기린은 군 소유의 미얀마 경제 지주 회사(MEHL)와의 합작 투자를 종료했다.[177][178][179] 이 합작 투자인 미얀마 브루어리는 미얀마 맥주를 포함한 여러 맥주 브랜드를 생산하며, 국내 시장 점유율 80%를 차지하고 있다.[179]

2월 8일, 레이저의 공동 창업자인 림 칼링은 버지니아 담배의 지분 49%를 소유한 싱가포르 담배 회사와의 합작 투자에서 지분을 매각하겠다고 발표했다. 버지니아 담배의 주요 지분은 MEHL이 소유하고 있다.[180]

2월 시위 동안 군인들이 여러 시위대를 사살한 후, 페이스북은 폭력을 조장하는 페이지와 관련하여 타트마도와 뉴스 웹사이트인 타트마도 트루 뉴스, MRTV를 포함한 정부 소유의 여러 계정을 정지시켰다.[184][185] 2월 25일, 페이스북은 타트마도와 관련 상업 단체의 모든 계정을 금지했다. 모회사인 페이스북 (현재 메타)도 인스타그램에 이 금지 조치를 시행했다.[186] 다른 기술 회사들도 뒤를 이어 유튜브는 MRTV 및 미야와디 TV를 포함한 정부 소유의 여러 채널을 종료했고, 틱톡은 플랫폼에서 여러 폭력 콘텐츠를 사용할 수 없도록 제한했다.[187]

2021년 4월 16일, 한국의 철강 대기업 포스코는 미얀마 자회사인 POSCO C&C가 군 소유의 미얀마 경제 지주 회사 (MEHL)와의 관계를 종료할 것이라고 발표했다.[188] 10월 27일, 인도 소유의 아다니 포트 & SEZ는 미얀마에 1.27억달러를 투자하여 컨테이너 터미널을 건설하려던 계획을 종료하겠다고 발표했다.[189]

6. 미얀마 민주 진영의 저항

2021년 2월 1일 쿠데타 이후, 국민민주연맹(NLD) 소속 의원들은 군사 정권에 저항하기 위해 연방의회대표위원회(CRPH)를 구성했다.[325] 이들은 2020년 총선에서 선출된 의원들로, 군부의 쿠데타를 인정하지 않고 민주주의 회복을 위한 활동을 시작했다.

2021년 4월 16일, CRPH는 국민통합정부(NUG) 수립을 발표했다.[282] NUG는 군부에 맞서 민주주의를 회복하고 국민을 대표하는 정부를 목표로 했다. NUG는 국제사회에 미얀마의 합법 정부로 인정받기 위해 노력하고 있다.

7. 정보 통제 및 언론 탄압

군부는 쿠데타 직후 정보 통제를 강화하고 언론을 탄압했다. 인터넷 접속을 차단하고, 페이스북, 트위터 등 소셜 미디어를 검열했다.[155][158][159][160] 또한, 독립 언론사들의 면허를 취소하고, 기자들을 체포했다.[85][84]

2021년 2월 1일 새벽, 국군은 국영 방송(MRTV)을 포함한 방송 채널 송출을 중단시켰고, 네피도의 전화선과 인터넷 접속을 끊었다.[46][343] 2월 4일, 미얀마 전역의 통신 사업자와 인터넷 제공 업체는 "국가의 안정을 보장"하기 위해 페이스북을 차단하라는 명령을 받았다.[155] 국영 통신사인 MPT는 페이스북 메신저, 인스타그램, 왓츠앱 서비스도 차단했으며, 텔레노르 미얀마는 페이스북만 차단했다.[156][155] 2월 5일, 정부는 소셜 미디어 접근 금지 조치를 인스타그램과 트위터까지 확대했다.[158][159]

2월 6일, 군 당국은 전국적으로 인터넷 중단을 시작했다.[160] 2021년 2월 14일부터 20일 동안 정부는 오전 1시부터 오전 9시까지 인터넷 접속을 다시 제한했다.[161][162][163][164]

3월 8일, 국영 방송 MRTV는 정보부가 미지마, 미얀마 나우, DVB, 7 데이 뉴스, Khit Thit Media 등 5개 현지 언론사의 면허를 취소했다고 발표했다. 이 발표는 해당 언론사들이 어떤 종류의 미디어와 기술을 사용해서든 출판 및 방송하는 것을 금지한다고 밝혔다.[85]

8. 쿠데타의 법적 근거에 대한 논란

국제법률가위원회는 군부가 쿠데타를 일으키면서 미얀마 헌법을 위반했다고 판단했다. 선거 부정 의혹은 헌법에 따른 비상사태 선포를 정당화하지 못했기 때문이다. 나아가, 법률가들은 군부의 행위가 기본적인 법치주의 원칙을 위반했다고 결론 내렸다.[116] NLD 역시 군부의 권력 장악에 대한 법적 근거를 거부했다.[117][118]

쿠데타 발표 당시 군부는 민 아웅 흘라잉이 주재한 회의에서 국가방위안보위원회(NDSC)가 2008년 미얀마 헌법의 417조와 418조를 발동했으며, 이것이 군부의 권력 장악의 법적 근거가 되었다고 밝혔다.[119][120] 그러나 헌법 417조는 국가방위안보위원회(NDSC)와 협의한 후 현직 대통령만이 비상사태를 선포할 수 있도록 규정하고 있다. 쿠데타 당시 NDSC 구성원의 절반은 대통령, 민간 선출 제2부통령, 상·하원 의장을 포함한 민간인이었고,[121] 이들은 모두 군부에 체포되었기 때문에[122] 이 회의가 헌법에 따라 소집될 수 있었는지는 불분명하다.[60][123] 현직 문민 대통령 윈 민은 자발적으로 자신의 역할을 넘겨주지 않았다. 대신 비상사태는 부통령 민 스웨에 의해 위헌적으로 선포되었다.[116] 윈 민은 10월 12일 법정 증언에서 쿠데타 전인 2월 1일에 두 명의 고위 군 장성이 "건강 악화"를 핑계로 자신에게 사임을 강요하려 했다고 밝혔다.[124]

이후 비상사태 선포는 418조에 따라 입법, 행정 및 사법 권한을 최고사령관에게 이양한다.[122]
